1. Seller and contact

These terms apply to every purchase of a license for the kluc from us, on our website or from within the kluc app. The use of the kluc is governed by the End-User License Agreement (EULA). If these terms and the EULA differ on the purchase, these terms apply.
2. Product
You buy a license key for the kluc, a macOS application that estimates the musical key, tempo, energy, quality and loudness of audio files and can write the results to tags and file names. The analysis is an automated estimate and is not always correct.
- System requirements: a Mac with Apple silicon (M1 or newer) running [[MIN MACOS]] or later. The kluc does not run on Intel Macs or other operating systems. Please check these requirements before you buy.
- Functionality and technical protection: the key unlocks analysis of an unlimited number of tracks for one person on up to two computers at a time. The kluc needs no account. It analyzes music without an internet connection, but it confirms the license online about once a week; if it cannot do so for 60 days, it works as the trial until the next successful check (details in the EULA, section 3a). Without a key, the kluc works as a trial for 20 tracks.
- Compatibility: The kluc reads and writes common audio formats and tags as described on https://thekluc.app. Changes to files are made only after you confirm them.
- Updates: we provide free updates, including security updates, needed to keep the kluc in conformity for at least two years from purchase. New major versions are not included unless stated on the product page.
Before you buy, you can try the kluc free of charge on 20 tracks. The paid version works the same as the trial.
3. Price and payment
The price is shown on the product page and at checkout. Prices for consumers include VAT; there are no delivery or other fees. Business customers in the EU outside Slovakia who enter a valid VAT ID may be charged without VAT under the reverse-charge rule. The available payment methods are shown at the start of checkout. Payments are processed by Stripe on our behalf; we do not receive your full card details.
4. How the contract is made
You choose "Buy" in the app, which opens a checkout window, or on our website. You enter your e-mail address and payment details and confirm the required statements (section 6). By clicking the button marked "Pay" (an order with an obligation to pay) you make a binding order. The contract is concluded when the payment is authorized. The contract and all documents are in English; a Slovak version of these terms is available on https://thekluc.app. We keep the contract and send it to you as described in section 5.
5. Delivery and confirmation
Immediately after payment we send to your e-mail address the license key, a confirmation of the contract including the confirmation of your consent and statement under section 6, these terms and the EULA, and an invoice. The application can be downloaded from https://thekluc.app at any time. If you do not receive the key within 24 hours, check your spam folder and contact us.
6. Right of withdrawal (consumers)
As a consumer you have the right to withdraw from the contract without giving a reason within 14 days of the day the contract was concluded, unless you lose this right as follows.
Loss of the right of withdrawal. The kluc is digital content not supplied on a tangible medium, and we supply the license key immediately. At checkout we therefore ask you (a) to give your express consent to the supply of the digital content beginning before the withdrawal period ends, and (b) to declare that you have been informed that by giving this consent you lose the right of withdrawal once the supply has begun. If you give the consent and the declaration, we have confirmed them to you under section 5, and the license key has been sent to you, you no longer have the right of withdrawal.
How to withdraw where the right applies. Use the function marked "Withdraw from contract here" at https://thekluc.app/withdraw, which is available throughout the withdrawal period, or send us an unambiguous statement, for example using the model form below, by e-mail to darovec@gmail.com or by post to our registered office. The deadline is met if you send the withdrawal before it expires. If you use the online function or the online form, we confirm receipt to you by e-mail without delay.
Effects of withdrawal. We refund all payments received from you without undue delay and at the latest within 14 days of receiving your withdrawal, using the same payment method you used, at no cost to you. After the withdrawal you must stop using the kluc and the license key and must not give them to others, and we may disable the key.

7. Liability for defects and complaints
We are liable for any defect that the kluc has when it is supplied and that becomes apparent within two years of supply. A defect means that the kluc does not match these terms, the product description, the trial version, or what you can reasonably expect from software of this kind. If a defect becomes apparent within one year of supply, it is presumed to have existed at supply unless we prove otherwise, or unless your computer does not meet the system requirements in section 2.
To make a complaint, write to darovec@gmail.com or to our registered office with your order number and a description of the defect. We confirm the complaint in writing without delay, state the period within which we will remedy the defect, and remedy it free of charge at the latest within 30 days of the complaint. If we reject the complaint, we tell you the reasons in writing. Please cooperate with us, to the extent reasonably possible with technically available means that burden you least, so that we can find out whether the cause lies in your computer's hardware or software; if you do not, you may have to prove that the kluc was defective at supply.
If the defect cannot be remedied, we do not remedy it within 30 days, it recurs, or it is so serious that it justifies it, you are entitled to a proportionate price reduction or, unless the defect is minor, to withdraw from the contract and receive a refund within 14 days. Your right to compensation for damage is not affected.
8. Request for redress and out-of-court dispute resolution
If you are a consumer and are not satisfied with how we handled your complaint, or believe that we have violated your rights, you may send us a request for redress to darovec@gmail.com. If we reject it or do not answer within 30 days of sending it, you may submit a proposal for alternative dispute resolution to the competent body, in particular the Slovak Trade Inspection (Slovenská obchodná inšpekcia, www.soi.sk). The list of alternative dispute resolution bodies is published by the Ministry of Economy of the Slovak Republic at www.economy.gov.sk. Supervision of consumer protection is carried out by the Slovak Trade Inspection, Inspectorate for the Bratislava Region, Bajkalská 21/A, P. O. Box 5, 820 07 Bratislava.
9. Business customers
If you buy as a business, sections 6 and 8 and the consumer provisions of section 7 do not apply, the Slovak Commercial Code applies, and the limitation of warranty and liability in the EULA applies.
10. Personal data
We process the data you give at checkout (name, e-mail address, billing address, VAT ID, order details) to conclude and perform the contract, issue invoices and meet our legal obligations. Details are in our privacy policy at https://thekluc.app/privacy.
11. Final provisions
These terms are governed by the laws of the Slovak Republic, in particular Act No. 108/2024 Coll. on consumer protection and the Civil Code; if you are a consumer, you also keep the protection of the mandatory laws of the country where you live. We may change these terms for future purchases; the version accepted at checkout applies to your purchase.
